Setting a Case for Finalization

When both parties have signed the required documents, a case can be set for finalization.  Finalization involves appearing before a judge of the circuit court, who will hear testimony regarding the facts of the case.  The judge will review the proposed judgment of dissolution of marriage, any settlement agreement which may be attached to that judgment, and any parenting agreement that may be attached to that judgment.  If the court is satisfied that the judgment is not unconscionable and in the best interests of the parties, the court will sign the order and the judgment will be entered immediately.  Often times, a transcript of the proceedings will be filed with the court.  That transcript, contains verbatim testimony of what went on before the bench on that particular day.  If there are no court reporters available on the date of finalization, and if both parties are in agreement, the court may proceed with finalization and enter a judgment of dissolution of marriage without there being a transcript or a record.
