Non-compliance with child support is a frequent occurrence in post-decree divorce litigation. Often, a person will withhold support payments in response to a lack of visitation time. Although these are mutual, exclusive issues, they often get clouded by a disgruntled former spouse. The proper legal method is to bring the non-compliant party back before the court to answer before the court as to the non-compliance. If the non-compliant party cannot respond to the court’s satisfaction, he or she may be held in contempt. Contempt can lead to sanctions, fines and even imprisonment.
