An uncontested case is one in which all of the issues have been resolved and each party is willing to sign settlement documents. A contested case is one in which there are issues in dispute and a resolution cannot be obtained by the parties.

Several of the issues that make up a contested case include: custody, support, visitation, division of property, allocation of debts, division of retirement benefits, valuations of businesses and properties. A contested case can last for years if one or both of the parties are unwilling to move the matter to a resolution.

If custody of minor children is not an issue, the case should move more quickly through the system. If custody is at issue, there is not quick resolution to the case. It is always in the parties best interests to try and work out a resolution without the court’s intervention.
