Divorce Lawyers New York - Child-Support as it Relates to Visitation Child-Support as it Relates to Visitation The duty and obligation to pay child support is unrelated to the right to seek visitation. Oftentimes, men or women feel that since they are not getting adequate visitation, that they do not need to pay child support. In other words, it's almost like a penalty. Since you're not letting me see the child or children, I will no longer continue to pay child support. The courts frown upon this activity. The nonpaying spouse can be held in contempt for not paying child support. In addition, the spouse that has physical custody of the children can be held in contempt for refusing to allow visitation. Thus, each issue has the ability to cause friction and also has the ability to be addressed by the court. However, the issues are unrelated as to each other. The court will refer to these issues as mutually exclusive. Once again, the obligation to pay child support is not related to the right to seek visitation.
